Court Denies Interior Ministry Access to Personal Data Collected with Toll Cameras

The Supreme Administrative Court (SAC) has declared null and void provisions of a government instruction which regulates the Interior Ministry's access to toll cameras. The SAC said that the provisions violate data protection rules. The ruling was published on the Court's website on Monday.

It may be appealed before a five-judge panel of the SAC within 14 days of the notification to the parties.

The instruction was issued by the Ministers of Regional Development and Public Works, of Interior and of Finance. According to the judges, the law does not provide for such an instruction to regulate access to the information systems used to establish breaches related to the payment of due toll charges and vignette charges.

The SAC ruling also states that an analysis should have been carried out regarding compliance with European Union law. An impact assessment on data protection should have been conducted, and, if necessary, prior consultations with the supervisory authority should have been held, given the fact that this concerns access to information that may affect (and possibly lead to the disclosure of) personal data.

New rules in the Road Traffic Act entered into force on September 7, 2025.
