site.btaConstitutional Court Dismisses Challenge to Constitutionality of Counter-Corruption Commission Election Procedure
The Constitutional Court has dismissed a motion, submitted by Velichie, MECh, and Vazrazhdane, to declare unconstitutional the nomination commission for selection of members of the Counter-Corruption Commission and terminated the proceedings. The ruling was adopted unanimously.
In its reasoning, the Court said that it dismissed the request and terminated the case because, before a ruling can be made in substance, amendments to the National Audit Office Act, adopted by the 51st National Assembly on January 28, 2026, repealed the Counter-Corruption Act, which included the contested provisions.
In November 2025, the Constitutional Court admitted for consideration the complaint filed by Velichie, MECh, and Vazrazhdane. At the end of July 2025, the parliamentary commission on prevention and counteraction of corruption voted 10-5 to constitute a nomination commission, whose task was to select the leadership of the commission.
