At its regular sitting here on Wednesday, the Council of Ministers adopted a decision designating national bodies for the protection of fundamental rights, including the right to non-discrimination, pursuant to Art. 77 of Regulation (EU) 2024/1689 of the European Parliament and of the Council of 13 June 2024 laying down harmonised rules on artificial intelligence (AI) and amending Regulations (EC) No 300/2008, (EU) No 167/2013, (EU) No 168/2013, (EU) 2018/858, (EU) 2018/1139 and (EU) 2019/2144 and Directives 2014/90/EU, (EU) 2016/797 and (EU) 2020/1828 (AI Act).
Designated national bodies will have the power to request and obtain access to any documentation created or maintained pursuant to the AI Act where access to that documentation is necessary for the effective exercise of their powers, in order to protect the fundamental rights of individuals, businesses, democracy, the rule of law and the protection of the environment, while promoting innovation and employment and helping to make the European Union a leader in the adoption of trustworthy AI.
