Supreme Court Upholds Dismissal of Registry Agency Appeal in Plovdiv Fair Case

The Supreme Court of Cassation has issued a final ruling that the Registry Agency cannot appeal a court’s decision reversing its refusal to register the increase of capital of the Plovdiv Fair.

By a ruling of July 20 the Supreme Court of Cassation upheld a ruling of the Plovdiv Appellate Court to dismiss an appeal by the Registry Agency against a court’s decision that its refusal to enter an increase of the capital of Puldin Tourinvest from BGN 177,984,899 to BGN 194, 299,299 by an in-kind contribution of 16,314,400 shares from the capital of the International Plovdiv Fair is unlawful. The Plovdiv Court has instructed the Registry Agency to register the increase.

The SCC panel upholds the motives of the lower court that the Registry Agency does not have legitimacy to appeal the reversal of its refusal to register the increase and that the ruling is non-appealable and final, therefore the appeal is inadmissible.
