President Radev Refers Termination of Rosenets Oil Port Concession to Constitutional Court

President Rumen Radev has referred the termination of the concession for the Rosenets port terminal to the Constitutional Court, the press secretariat of the head of State said Friday.

On July 21, Parliament adopted amendments to the legislation on control of the implementation of restrictive measures in view of Russia's actions destabilising the situation in Ukraine. The concessions awarded for carrying out activities at strategic sites of national security importance affecting oil and petroleum products made from crude oil originating in Russia or exported from Russia shall be terminated within one week, the MPs decided. The amendments effectively terminate Lukoil's concession for the port of Rosenets. The amendments were gazetted this Friday. 

Decisions in the field of energy must always rest on the need for reliability and continuity of supply of raw materials and on guaranteeing affordable prices for citizens and industry. The price for hasty and ill-considered decisions is always paid from the pockets of those forced to bear their consequences," the President stated in his arguments.

The hasty adoption of legal amendments terminating the concession of the Rosenets port terminal not only contradicts the fundamental principle of the rule of law in the Constitution, but is also an example of irresponsible attitude towards the state and citizens. In adopting this radical approach, neither the interests of consumers and the risks of rising fuel and commodity prices, nor the potential threats to thousands of employees at the petrochemical plant, or the possible legal action against Bulgaria have been taken into account," the head of State added in his reasoning.

According to him, "the constitutional flaws of this law and the serious risks it poses to Bulgarian citizens are sufficient grounds" for referral to the Constitutional Court with a request to establish the unconstitutionality of the legal amendments.
