Constitutional Court Admits President Radev's Request Concerning Texts on Bulgarian National Audit Office

The Constitutional Court (CC) has admitted for consideration on the merits the President's request to establish the unconstitutionality of a text in the decision on changing the procedure for nominating candidates for the presidency of the Bulgarian National Audit Office, the CC said Friday.

The ruling was unanimously adopted by 10 votes.

On July 11, President Rumen Radev referred the case to the CC over the National Assembly's choice of the acting president of the Bulgarian National Audit Office. Radev asks that part of the National Assembly's decision of July 7 on the issue be declared unconstitutional. The President believes that this decision not only does not overcome the consequences of the CC decision of June 22, 2023, but on the contrary, it constitutes a failure to implement the same decision. 

The President finds in the actions of the MPs a violation of the principle of legality and the principle of independence of the Bulgarian National Audit Office.

On July 12, the CC opened a case with judge Yanaki Stoilov being appointed as rapporteur.
