site.btaConstitutional Court Opens Three Cases Following Budget Challenges by GERB–UDF, Continue the Change

The Constitutional Court has instituted two cases following referrals by MPs from GERB–UDF and Continue the Change (CC) challenging the State Budget Act, which was adopted conclusively by Parliament on July 24, 2026. The Court has also opened a case following a petition challenging the constitutionality of provisions of the transitional and final clauses of the 2026 Public Social Insurance Budget Act, the Court’s press office said on Friday. 

Judge Sonya Yankulova was appointed rapporteur on the two cases concerning the State Budget Act, while Judge Borislav Belazelkov was appointed rapporteur on the case concerning the Public Social Insurance Budget Act. The Court will decide whether the petitions will be admitted to examination on the merits.

One of the cases follows a request by 50 MPs seeking a declaration of unconstitutionality of the entire 2026 State Budget Act. The challenge argues that the law contradicts constitutional provisions related to the principles of the rule of law and international treaties.

The second case was instituted following a request by 53 MPs and concerns specific provisions in the transitional and final clauses of the State Budget Act relating to the Labour Code and the Judiciary System Act. 

The third case was also opened following a request by 53 MPs and concerns amendments to the Public Social Insurance Budget Act related to the Health Act. 

Earlier in the day, GERB-UDF submitted a request to the Constitutional Court to declare the 2026 State Budget Act unconstitutional, arguing that it conflicts with the Public Finance Act. Shortly after that, Continue the Change announced that it would refer both the State Budget Act and the Public Social Insurance Budget Act to the Court.
